The Real Path to Land Chinese Pharma Equipment in a Malaysian Plant
In Malaysia, NPRA (the National Pharmaceutical Regulatory Agency) regulates medicines and inspects the buyer's plant against PIC/S GMP — it does not issue any "equipment registration" for an imported machine. The supplier's job is to deliver GMP-ready, on-site-qualifiable equipment (DQ/IQ/OQ/PQ) so the buyer passes that facility GMP inspection.
Pharma production equipment classifies under Customs Chapter 84 (e.g. tablet/granulation 8479.82, sterilizers/autoclaves 8419.20, dryers 8419.39, filling & packing lines 8422, centrifuges/filtration/purified-water 8421). Most Chapter-84 industrial machinery already carries 0% Malaysian MFN import duty; an ACFTA/RCEP certificate of origin (Form E) locks in zero duty, with Sales Tax (SST) payable at clearance. The machine needs no drug-type import licence — no MA, no registration certificate.
Before shipment, the supplier delivers the qualification pack that underpins PIC/S GMP: a User Requirement Specification (URS), contact-part material certificates (316L stainless, FDA/food-grade elastomers), surface-finish records (e.g. Ra ≤ 0.8 μm), Design Qualification (DQ), and a documented Factory Acceptance Test (FAT) run at the China works. This pack is the head of the buyer's GMP document chain.
Once on site, run a Site Acceptance Test (SAT), then Installation (IQ), Operational (OQ) and Performance (PQ) Qualification plus instrument calibration. This is exactly what NPRA scrutinizes during the buyer's facility GMP inspection — complete qualification protocols, deviation handling, and traceable calibration records. Supplier-provided protocols, commissioning and qualification support directly affect whether the buyer passes.
Equipment with pressure parts (sterilizers/autoclaves, reactors/fermenters, pressure vessels in CIP/SIP skids) counts as an "unfired pressure vessel" under the Department of Occupational Safety & Health (DOSH): under OSHA 1994 and the Plant Requiring Certificate of Fitness Regulations 2024 (P.U.(A) 99/2024, which from 1 June 2024 superseded the repealed 1967 Factories & Machinery Act), it needs DOSH design approval first, then a passing post-install inspection to obtain a Certificate of Fitness (CF, valid 15 months) — no operation without it. Electrical safety/EMC also applies, and trade-use weighing devices need verification under the Weights & Measures Act 1972 — enforced by the Ministry of Domestic Trade (KPDN), with SIRIM / the National Metrology Institute of Malaysia (NMIM) as the national standards custodian and verification/stamping carried out by KPDN-licensed bodies.
